Terms of Service

1. Acceptance of Terms

By downloading, installing, or using LootWheel, you agree to be bound by these Terms. If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and Ideaform Capital, LLC.

2. Description of Service

LootWheel is a social gifting application that allows users to:

• Create customizable virtual prize wheels with weighted odds
• Send "spin codes" to friends, family, or colleagues via SMS
• Track spin history and reward outcomes

The Service is provided on a free and subscription basis (Free, Premium, or Family tiers) as described in the app.

3. User Accounts

3.1 Registration

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use.

3.3 Account Deletion

You may delete your account at any time through the app settings. Deletion is permanent and removes all associated data within 30 days.

4. Acceptable Use

You agree NOT to:

• Use the Service to send unsolicited or harassing messages to strangers
• Upload or transmit illegal, harmful, threatening, abusive, or offensive content
• Attempt to reverse engineer, decompile, or hack the Service
• Use automated systems (bots, scrapers) to access the Service
• Impersonate any person or entity
• Use the Service for any illegal purpose

5. SMS Messaging

By using the Service, you understand that:

• SMS messages are sent via Twilio on behalf of users who choose to send spins
• Standard messaging rates may apply based on your carrier plan
• You can opt out of SMS at any time by replying STOP to any message
• Replying HELP provides assistance information

You may only send spins to individuals with whom you have an existing relationship. Sending unsolicited spins to strangers is prohibited.

6. Subscriptions & Payments

6.1 Subscription Tiers

• Free: 1 wheel, up to 5 prizes, basic features
• Premium: Unlimited wheels and prizes, all features
• Family: Premium features for up to 6 family members

6.2 Billing

Subscriptions are billed through Apple App Store or Google Play. All payments are handled by these platforms. We do not store payment card information.

6.3 Cancellation

You may cancel your subscription at any time through your platform account settings. Cancellation takes effect at the end of the current billing period.

6.4 Refunds

Refund requests are subject to Apple App Store or Google Play policies. Contact the respective platform for refund inquiries.

7. Intellectual Property

LootWheel and all related content, including but not limited to software, designs, graphics, and text, are the property of Ideaform Capital, LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IDEAFORM CAPITAL, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Indemnification

You agree to indemnify and hold harmless Ideaform Capital, LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Service or violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Georgia.

13. Changes to Terms

We may modify these Terms at any time. We will notify users of significant changes via in-app notification or email. Continued use of the Service after changes constitutes acceptance of the revised Terms.
